June 27, 2018 Juana Rivas was sentenced to five years in prison for the crime of child abduction (two and a half for each of the minors) and six years of disqualification to exercise parental rights of their children.
He filed a resource, but the Provincial Court of Granada has ratified the sentence imposed for not giving their children 5 and 12 years old to their father in Italy in May 2016, as they had agreed.
The only change of the Court of Appeal refers to the reduction of the amount of compensation that the mother must pay to Francesco Arcuri, the father of her children, for moral damages: from 30,000 to 12,000 euros.

Juana Rivas can still file an appeal against the Supreme Court against this judgment, so it seems unlikely that he will be imprisoned shortly.
Even so, Francesco Arcuri's lawyer, Enrique Zambrano, says he is waiting for his client to indicate whether or not he wants to execute the sentence and affirms that there are "Little chance of the cassation thriving in the Supreme".
Remember that the Juana Rivas case has aroused great media interest, since in summer 2016 he fled with his children to avoid giving them to his ex-partner.
The last thing we learned about her was in October 2018, when she decided again not to give her children to Arcuri, after denouncing him in Italy for mistreating her youngest son. But in the end he had to let the children return with their father, after seven consecutive days that a ruling issued by the court of Cagliari had granted the mother.
Although this was not the first complaint for physical and psychological abuse filed by Juana Rivas, although it seems that, at least so far, they have not been taken into account by the courts.
And in the middle of the children, that if their mother enters the jail (as it seems that it will be) they will spend time without seeing her, since they live in Italy with their father. There are always losers.
