A controversial case of surrogacy: a woman gives birth to her son's son

Surrogate motherhood, also known as "rent belly", is always controversial because it is not something that can be done in all countries. In many it is allowed, the laws contemplate and allow it, but in others, such as Spain, is prohibited, and that is why when we receive news about it, we are a little amazed.

The last of the cases that has become news is one that happened last year in the United Kingdom and is now known because it is these days when the protagonists have explained it. They are a mother, her son and her grandson. Or maybe I should say a mother and her two children. Or a mother, her son and his brother and son. Why so much complication? Because the woman gave birth to the son of her gay son, who is also single and without commitment.

How it all happened

The father's name is Kyle, Kyle Casson, 27, and has been wishing to be a father since he was 24. His desire was such that he decided that he would look for someone who could gestate his baby. With an anonymous donor's egg and sperm, the fertilized egg would be implanted in the womb of a woman who could and would like to be the circumstantial mother of that baby.

At first he looked for women who could do it. As a single man, he had many problems finding one, but he finally found a woman willing to lend his belly. The problem was that the thing "did not set" and in the end could not be. In desperation, victim of the desire to be a father, he finally asked for help from his mother, Anne-Marie, 46, and she He did not hesitate to agree to make his dream possible.

The fertilization took place and nine months later Miles was born, a baby who is now eight months old and who is Kyle's son, but also, in theory, his grandmother's son. In this way, he he became the first man in the UK to have a baby through surrogacy.

Obviously, he didn't do it to support that honor. He did it because he wanted to have a baby, and his mother did it to make him happy. She consulted her husband and they both agreed to do so.

Under the laws of the United Kingdom, Miles is the biological son of Kyle's parents, and he is his brother. However, biologically, the sperm is from Kyle and the donor's egg, so the mother-grandmother is clear that "he is not biologically linked to me, apart from that he is my grandson."

To solve this mess, Kyle had to adopt the baby, Miles, to be considered his father and not his brother, but he encountered a pitfall, a single person cannot request the adoption of a baby. In fact, the law says that a surrogate mother must deliver the baby born to the couple who has hired her services. Does this mean that it is illegal to hire a woman if you are a person without a partner? Apparently not. As we read in the Daily Mail, a single person can carry out a surrogacy procedure. The problem is that you will not be able to adopt it later, because you don't have a partner.

The case went to court, because Kyle wanted his son to be, by law, his son, and he succeeded. Last week, the Superior Court of Justice ruled that the process was legal and that, although it should not give the child to a single parent, as a father and son they are legally linked as brothers the situation is different. Come on, the judge considered that because they were brothers, no law was being violated and allowed adoption. The social workers agreed that the baby and the father were together, as such, as soon as possible and the bond was strengthened in a father and son relationship.

The reasons to be a father

Kyle, before the news, decided to give his reasons, explain why he had decided to have a son and why he decided to do it this way:

I understand that not everyone agrees, everyone is free to have their own opinion. I have a son and I am very happy. As long as people can provide a home and have support, I don't see why someone should be denied the right to be a father.
Regardless of the sexuality, gender and time that can be provided for the child, I don't see what the problem is. What did I pay for him? It is not taxpayer money, I own my own house and I will return to work.
My father told me "why don't you wait to meet someone?" But nobody can guarantee that I will meet anyone. I did not choose to be gay, I was born that way. I was born unable to have children. I can't go and have sex with a woman. Being a father was a priority in my life and now I have succeeded.

The criticisms have not been long in coming and there are requests for the law to be reviewed and for abuse to be controlled and avoided, as many consider what Kyle and Anne-Marie, their mother, have done. For them, the most logical option on the part of the father would have been to have a partner previously, or to have adopted a child. He, in fact, intended to do so when the idea of ​​being a mother passed through his mind because he believed it was the only option to be a father. However, he learned about the possibility of having a biological child with a rental belly and he decided that he wanted to do it that way, who wanted to have a child of his.

It is a subject with many variants, with many issues to consider and many ethical questions. It is a baby who will not have a mother, who will not receive the heat from her breast, who will not breastfeed, who will not be cared for by the woman who gave birth to her, and this generates much controversy. But what about when a couple of women have a baby? That baby has no father. Is it comparable? Is not the same?

I am a little with the father. As long as there is honey, as long as there is a good relationship and while the child is well taken care of, the rest can be perfectly in the background.
